These terms and conditions (the “Terms”) govern the use of the services offered by Boothy McBooth, including the rental of photo booths and related equipment (the “photo booth” or the “booth”). If you do not agree to these Terms, you may not use the Services.
1. Acceptance of Terms
By accessing our website or using our services, you confirm that you have read, understood, and agree to these Terms of Use. These terms form a binding agreement between you and Boothy McBooth.
2. Eligibility
Our website and services are intended for users aged 18 and older. If you are under 18, you may use our site only with the supervision and consent of a parent or guardian.
3. Use of the Website
You agree to use our website only for lawful purposes and in accordance with these Terms of Use. You must not:
Use the website in any way that breaches applicable laws or regulations in Australia.
Transmit or upload harmful, illegal, or inappropriate content.
Attempt to gain unauthorised access to our systems or interfere with our website’s functionality.
4. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Boothy McBooth or its licensors and is protected by copyright, trademark, and other intellectual property laws under Australian legislation. 5. Services
We provides photo booth rental services for events such as weddings, parties, corporate events, etc. The services include the rental of the photobooth equipment, set-up and takedown of the equipment, and on-site attendant(s).
6. Reservations
To make a reservation, you must complete the online reservation form or contact us directly. To secure the date, a non-refundable deposit is required to hold your reservation. The remaining balance is due no later than 14 days before the event date. We understand unforeseen circumstances may occur; please reach out to us if you need to discuss adjustments, rescheduling, or cancellations.
7. Payment
Payment can be made by credit card. If payment is not received by the due date, we reserve the right to cancel the reservation.
8. Cancellation and Refunds
If you need to cancel your reservation, you must notify us in writing. The deposit is non-refundable. If the cancellation is made more than 14 days before the event date, a refund of the remaining balance will be issued. After the deposit, cancellations made less than 14 days before the event date will result in a refund of 50% of the remaining balance. Rescheduling the date of the event is free if done 7 days in advance, subject to availability.
9. Limitation of Liability
The Company is not liable for any damage to or loss of personal property left in or around the photobooth. The Company is also not liable for any injury caused by the use of the photobooth equipment.
To the fullest extent permitted by Australian law, Boothy McBooth and its affiliates will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website or services. This includes, but is not limited to, errors, interruptions, loss of data, or viruses. Your statutory rights under Australian Consumer Law are not affected by this limitation.
10. Indemnification
You agree to indemnify and hold Boothy McBooth, its affiliates, and employees harmless from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms of Use or your use of the website.
11. Event Conduct and Responsibilities
For events where our photo booth services are provided, you agree to:
Ensure that the venue meets the necessary requirements for equipment setup and operation.
Provide a safe and accessible environment for our staff and equipment.
Take responsibility for any damage caused to our equipment by you, your guests, or the venue.
We reserve the right to terminate services during an event if conditions become unsafe or equipment is at risk of damage.
12. Use of Event Photos
By using our photo booth services, you grant Boothy McBooth permission to use event photos for marketing and promotional purposes unless otherwise agreed in writing. If you wish to opt out, please notify us prior to the event.

Our website may include links to third-party websites. These links are provided for convenience only. We are not responsible for the content, privacy practices, or terms of use of these external sites. Access them at your own risk.
14. Changes to Terms
